Terms of Use

These conditions govern every visit, search, and use of Guadalupe County Criminal History. By continuing to use the website, a visitor accepts all terms below. Anyone who does not agree must stop using the site.

NO FCRA USE. Guadalupe County Criminal History is privately operated and has no connection to a local, New Mexico, or federal government body. The site and its advertising partners do not offer tools for credit, employment, insurance, tenant, or other decisions regulated by the Fair Credit Reporting Act (FCRA). This is a records-reference resource, not a private investigator or consumer reporting agency.

1. What This Website Is

This private reference site operates independently of government. It does not hold official criminal records, retrieve files, conduct official checks, or submit paperwork for visitors.

Its role is to identify sources for Guadalupe County records, including the sheriff, New Mexico courts, NMDPS State Central Repository, and New Mexico Sex Offender Registry, as well as outside research tools.

2. Rules for Using This Site

You agree that you will not:

  • Use the website in violation of federal, New Mexico, or local law
  • Harass, stalk, threaten, or intimidate a person with information found here
  • Apply site content to hiring, housing, credit, or insurance decisions
  • Attempt unauthorized access to any account, server, or system
  • Deploy bots, scraping software, or other automated collection tools
  • Disrupt site performance or interfere with another visitor's access

3. No Harassment, Stalking, or Discrimination

Information from the site or a linked tool must not be used to stalk, harass, threaten, intimidate, or unlawfully discriminate. Misuse can also violate criminal law. New Mexico registry information is provided for public safety, and §29-11A-8 NMSA 1978 and related penalty provisions must be read with the registry's current warning. Vigilante acts and blacklisting are forbidden.

4. We Are Not a Consumer Reporting Agency

Guadalupe County Criminal History is not a consumer reporting agency under the FCRA. Neither the site nor its advertising partners produces consumer reports or services designed to screen applicants, review rental requests, set insurance terms, or assess credit. A visitor must not use site or linked-tool data to:

  • Make an employment decision
  • Evaluate a renter or housing applicant
  • Set credit or insurance eligibility or terms
  • Decide access to a license, permit, or public benefit
  • Carry out any other FCRA-regulated purpose

A legally compliant check for a regulated purpose must come from an authorized official channel or a qualified FCRA-compliant provider.

5. No Legal Advice

Site content is not legal advice. General information about Guadalupe County records cannot determine how a charge, conviction, warrant, or expungement rule applies to one matter. Consult a licensed New Mexico attorney for that analysis.

6. No Warranties

All content and services are supplied "as is." No warranty is made that:

  • Information will always be complete, accurate, or current
  • The site will operate continuously
  • Pages will be free of defects or security weaknesses
  • An outside search provider will return complete or correct matches

Charges, dismissals, expungement orders, and agency procedures can change after publication. Gaps or delays are unavoidable. Nothing here is an official statement from the Guadalupe County Sheriff, a New Mexico court, or another government office.

7. Third-Party Services and Links

Links may point to sheriff pages, court portals, New Mexico agencies, legal resources, and commercial search services. Those destinations are independently controlled. The site is not responsible for their content, availability, privacy practices, prices, or terms.

8. Intellectual Property

Text, graphics, logos, and code belong to Guadalupe County Criminal History or its content partners. Copying, distributing, modifying, or creating derivative works requires prior written permission.

9. Limits on Our Liability

To the fullest extent permitted by law, the site is not liable for damage arising from its use, including reliance on information found here or through a linked service.

10. Indemnification

A user agrees to indemnify and hold the site harmless from claims, actions, demands, legal fees, and costs caused by that user's conduct or breach of these terms.

11. Governing Law

New Mexico law governs these terms. Any dispute related to use of the site must be brought in a court located in New Mexico. The Inspection of Public Records Act, §§14-2-1 through 14-2-12 NMSA 1978, governs records of public bodies, while §29-10-6 provides subject access to a person's own state arrest-record information. Neither law makes this private site a government custodian.

12. Changes to These Terms

These terms may be revised at any time. A revised version takes effect when it is posted here.

13. Cutting Off Access

Access may be restricted or ended at any time, for any reason, without advance notice.

14. Severability

If one provision is held invalid or unenforceable, the remaining terms continue in force. The affected provision will be limited only as needed to make it enforceable.
